1. Agreement to Terms

By accessing or using 360 Hextile software and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

2. License Grant

2.1 Software License

Upon purchase, we grant you a non-exclusive, non-transferable license to:

Install and use the software on the number of machines permitted by your license tier
Use the software for personal or commercial projects
Create unlimited content using the software

2.2 License Details

Maximum resolution: 8192 x 4096 pixels
Single image generation
2 machine activations

2.3 Restrictions

You may NOT:

Redistribute, resell, or sublicense the software
Reverse engineer, decompile, or disassemble the software
Remove or alter any proprietary notices
Use the software to create competing products
Share your license key with others
Circumvent license validation mechanisms

3. Account Registration

To use our Services, you must:

Be at least 18 years old
Provide accurate registration information
Maintain the security of your account credentials
Promptly notify us of unauthorized access

You are responsible for all activities under your account.

4. Payment and Pricing

All prices are in USD and include applicable taxes where required
Licenses are perpetual (one-time purchase, no subscription)
Payment is processed securely through Stripe
You receive immediate access to download upon successful payment

5. Refund Policy

We offer a 30-day money-back guarantee:

Request a refund within 30 days of purchase for any reason
Refunds are processed to the original payment method
Upon refund, your license will be revoked
Abuse of the refund policy may result in account restrictions

6. Content Ownership

6.1 Your Content

You retain full ownership of all content you create using 360 Hextile. We claim no rights to your generated panoramas or any derivative works.

6.2 Our Software

360 Hextile software, including all code, algorithms, models, and documentation, remains our exclusive property. The license grants usage rights only, not ownership.

6.3 AI-Generated Content Disclaimer

360 Hextile uses AI diffusion models to generate images. We do not guarantee the originality or copyrightability of AI-generated outputs. You are solely responsible for your use of generated images, including any commercial use. We are not liable for any third-party intellectual property claims arising from AI-generated content.

7. Updates and Support

We provide software updates at our discretion
Major version upgrades may require additional purchase
Support is provided via email and Discord community
We do not guarantee response times for support requests

8. Disclaimers

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

Merchantability and fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy of generated content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

Loss of profits or revenue
Loss of data
Business interruption
Cost of substitute services

Our total liability shall not exceed the amount you paid for the license.

10. Termination

We may terminate or suspend your license if you:

Violate these Terms
Engage in fraudulent activity
Abuse the refund policy
Attempt to circumvent license restrictions

Upon termination, you must cease all use of the software and delete all copies.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will provide notice of material changes via email or prominent website notice.

14. Gallery Terms

The 360 Hextile Gallery (gallery.360hextile.com) is a separate service from the desktop software license. The following terms govern your use of the Gallery.

14.1 License to Your Uploads

When you publish content to the Gallery, you grant 360 Hextile a non-exclusive, worldwide, royalty-free license to display, distribute, create thumbnails and variants of, and promote your images on gallery.360hextile.com, 360hextile.com, and associated marketing materials. This license is revocable — you may delete your gallery uploads at any time, which terminates this license for future use. Copies already distributed in marketing materials may persist for a reasonable wind-down period.

14.2 Your Representations

You represent and warrant that you have all necessary rights to publish any content you upload to the Gallery. Content must comply with our Community Guidelines.

14.3 Content Removal

360 Hextile reserves the right to remove any content from the Gallery at its sole discretion without prior notice. Gallery access may be suspended or terminated for violations of these Terms or the Community Guidelines.

14.4 Gallery Bans and Software License Independence

A Gallery ban or suspension does NOT affect your desktop software license. You paid for the application and retain your right to use it locally. Only your ability to publish to and interact with the Gallery is affected.

14.5 User-Generated Content

360 Hextile is a platform, not a publisher of user-uploaded content. Users are solely responsible for the content they upload. 360 Hextile does not pre-screen uploads but will act promptly on reported violations.

14.6 Indemnification

You agree to indemnify, defend, and hold harmless 360 Hextile and its officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from content you upload to the Gallery or your violation of these Terms.

15. DMCA and Takedown Policy

We respect intellectual property rights and respond to valid copyright takedown requests in accordance with the Digital Millennium Copyright Act (DMCA).

15.1 Takedown Requests

If you believe content on the Gallery infringes your copyright, email a takedown request to dmca@360hextile.com. See our Community Guidelines for the full list of required information and the complete takedown process.

15.2 Counter-Notifications

If you believe your content was removed in error, you may submit a counter-notification to dmca@360hextile.com. We will follow the statutory counter-notification process and may restore the content if the counter-notification is valid.

15.3 Repeat Infringer Policy

Users who receive three or more valid, uncontested takedowns will receive a permanent Gallery ban. This policy applies to the Gallery only and does not affect an existing desktop software license.

15.4 Accountability

All takedown requests, counter-notifications, and resulting actions are logged and retained for accountability and legal compliance purposes.
