1. The short version

In short: if something of yours is on the Gallery without your permission, tell us and we will take it down.

This page covers content published to the 360 Hextile Gallery. If you own a copyright and you believe Gallery content infringes it, send us a notice using the process below and we will act on it.

If your issue is not about copyright — harassment, spam, prohibited content — that goes through the report flow in the Community Guidelines instead. That route is faster for those cases.

2. Designated agent

In short: send copyright notices here, in writing.

Email reaches us fastest. Post works too, at the address above.

3. What a takedown notice must contain

In short: six things. Miss one and we may have to come back to you before we can act.

1. Identification of the copyrighted work you say has been infringed
2. The URL of the infringing Gallery image, so we can find exactly the right one
3. Your contact information — name, address, email, and phone number
4. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law
5. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf
6. Your physical or electronic signature

Please send one notice per image where you can. A single notice listing many URLs is fine, but each URL needs to be identified clearly.

4. What happens next

In short: we aim to review within 72 hours, remove or hide the content if the notice is valid, and tell the person who posted it.

• We aim to review a complete notice within 72 hours.
• If the notice is valid, we remove or disable access to the content.
• We tell the person who posted it what happened and pass on the substance of the notice, so they can respond if they think it is a mistake.
• We keep a record of the notice and of the action we took.

5. Counter-notification

In short: if your content was removed by mistake, you can tell us so, and it may go back up.

If you believe your content was removed in error or misidentified, send a counter-notification to the designated agent above. It must include:

1. Your contact information — name, address, email, and phone number
2. Identification of the removed content and where it appeared before it was removed
3. A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification
4. Your consent to the jurisdiction of the courts where you live, or where our agent is located if you are outside those courts' reach
5. Your physical or electronic signature

We pass a valid counter-notification to the person who filed the original notice. If they do not pursue the matter, we may restore the content.

6. Repeat infringers

In short: three valid, uncontested takedowns means a permanent Gallery ban. Your software licence is untouched.

An account that receives three or more valid, uncontested takedowns is permanently banned from the Gallery. We keep this policy because it is a condition of safe-harbour protection, and because it is the right rule.

A Gallery ban does not revoke your 360 Hextile software licence. You paid for the application and you keep the right to run it on your own machine. Only publishing to and interacting with the Gallery stops.

7. Canada's notice-and-notice system

In short: under Canadian law we forward valid notices to the person who posted the content, and keep a record.

Canada's Copyright Act uses a notice-and-notice system. When we receive a valid notice about content on the Gallery, we forward it to the user who posted it and keep a record.

8. Notices sent in bad faith

In short: this is not a route for settling taste disputes, and a knowingly false notice has legal consequences.

Knowingly misrepresenting that material is infringing carries liability for damages, including costs and legal fees, under the law of most jurisdictions that recognise this process. We take that seriously in both directions.

If you dislike an image, or you think it resembles your style, that is not a copyright claim. Please use the reporting flow in the Community Guidelines, or just get in touch.

9. Not a copyright issue?

In short: use the flag button on the image, or the reporting routes in the Community Guidelines.

Every image in the Gallery has a flag button. Pick the reason that fits — illegal content, prohibited content, spam, harassment, or other — and submit. Reports are anonymous and an administrator reviews every one. The full policy is in the Community Guidelines.
