Version 2.0 - Effective 2026-07-31 END USER LICENCE AGREEMENT 360 HEXTILE Copyright (c) 2024-2026 [ENTITY-NAME — set LEGAL_ENTITY_NAME]. All rights reserved. This is the agreement for the software you install on your own computer. It is written to be read, not skimmed past. Each section opens with a plain summary, and the full clause follows underneath. 1. WHO THIS IS BETWEEN In short: this covers the app on your machine. A separate agreement covers the website, the store, and the Gallery. This agreement is between you and [ENTITY-NAME — set LEGAL_ENTITY_NAME], based in British Columbia, Canada, which makes and licenses 360 Hextile ("the Software"). When this agreement says "we" or "us", that is who it means. It governs the Software you install and run on your own computer, and nothing else. The website, the store, your account, and the 360 Hextile Gallery are governed by the Terms of Service at https://360hextile.com/legal/terms. By installing or using the Software, you accept this agreement. If you do not accept it, do not install or use the Software. 2. YOUR LICENCE In short: you buy it once and keep it. Standard runs on two machines, Pro on four. Subject to this agreement and a valid licence key, we grant you a non-exclusive, non-transferable, perpetual licence to install and use the Software. How many machines you may activate depends on the edition you bought: Standard edition ..... 2 machine activations Pro edition .......... 4 machine activations You may deactivate a machine and move that activation to another one. You may use the Software for personal projects and for commercial ones, and you may create as much output as you like. There is no per-image fee, no output cap, and no royalty. This is a licence to use the Software, not a sale of it. The code, the algorithms, the templates, the documentation, and our names and logos remain ours. 3. WHAT YOU MAKE IS YOURS In short: every image you generate belongs to you. We claim nothing, and we never train on your work. All right, title and interest we may hold in the images you generate with the Software vests in you. You can sell them, license them, publish them, or keep them private. You do not owe us credit and you do not owe us a share. All image generation runs locally on your own GPU. Your prompts and your images stay on your machine unless you choose to publish them to the Gallery or attach them to a feedback report. We never train any model on your work. Two honest limits: we cannot promise that an AI-generated image is original, copyrightable, or free of anyone else's rights, and nobody can. How you use what you generate is your responsibility, including commercial use, and we are not liable for third-party intellectual-property claims arising from generated images. 4. THE MODEL LICENCES FOLLOW THE OUTPUT In short: the AI models carry their own licences, and some of them restrict what the output may be used for. The Software runs AI diffusion models that are downloaded separately and are licensed by their own authors, on their own terms. Several of those licences — OpenRAIL++ and its relatives among them — carry use restrictions that follow the output, not just the model. Those restrictions apply to you, and this agreement does not override them. The licence badge shown against each model in the app, and the attribution page at https://360hextile.com/legal/attribution, tell you what each model allows. Complying with them is your responsibility. 5. WHAT YOU MAY NOT DO In short: don't resell it, don't crack it, don't share your key. You may not: (a) redistribute, resell, rent, lease, or sublicense the Software, or any component of it, whether on its own or bundled with something else; (b) reverse engineer, decompile, or disassemble the Software or any of its components, including the NVIDIA CUDA and cuDNN libraries — except to the extent that mandatory law in your country expressly permits it despite this restriction, in which case that law prevails; (c) remove or alter any proprietary notice, label, or mark; (d) share your licence key, or use a key issued to someone else; (e) circumvent, disable, or interfere with licence validation; or (f) use the Software for any unlawful purpose. 6. NVIDIA COMPONENTS In short: the bundled NVIDIA libraries come with NVIDIA's own rules, and one of them is that this software must never be used in life-critical systems. The Software includes NVIDIA CUDA Toolkit and cuDNN runtime libraries. These components are subject to the NVIDIA CUDA Toolkit End User License Agreement and the cuDNN Software License Agreement. By using the Software, you agree to comply with NVIDIA's terms. The NVIDIA components: - require an NVIDIA GPU to operate; - may not be reverse engineered, decompiled, or disassembled; - may not be redistributed separately from the Software; - may NOT be used in Critical Applications, including but not limited to military weapons systems, life support equipment, nuclear facilities, avionics, or autonomous vehicle control systems. The Software incorporates open-source components under a range of licences (BSD, MIT, Apache 2.0, and others). The complete list, with full licence texts, is in the THIRD-PARTY-NOTICES.txt file installed alongside the Software and at https://360hextile.com/legal/attribution. 8. UPDATES AND SUPPORT In short: updates to 360 Hextile 1.x are free. A future major version might not be, and we will say so before it happens. We ship free updates for as long as we're shipping 360 Hextile 1.x. A future major version may be a separate purchase — if that happens, we'll say so before it does. Support runs by email and through the Discord community. We read everything, but we do not promise a response time. 9. ENDING THIS AGREEMENT In short: a refund or a serious breach revokes the licence — and we are honest about what revoking actually does. This agreement runs until it ends. It ends if you stop using the Software and remove it, or if we revoke your licence because you breached this agreement, committed fraud, abused the refund policy, or circumvented licence validation. It also ends when you take a refund, under the Refund & Beta Policy at https://360hextile.com/legal/refund. What a revoked licence actually does, stated plainly: you can no longer download the Software, and you can no longer activate it on a new machine. An installed copy that never reconnects to the internet may keep running. We cannot reach it, and we will not pretend otherwise. We ask you to uninstall it. Every image you already generated stays yours. 10. WARRANTY DISCLAIMER AND LIABILITY In short: it comes as-is, and if something goes badly wrong our liability is capped at what you paid. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY IS CAPPED AT THE AMOUNT YOU PAID FOR THE LICENCE. The disclaimed warranties include merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be error-free or run uninterrupted. Some places do not allow limits like these. Nothing here takes away any protection that the law where you live makes mandatory, and where that is the case, these limits do not apply to you. 11. EXPORT COMPLIANCE In short: don't take it somewhere it is illegal to take it. You agree to use 360 Hextile in compliance with Canadian and United States export control laws, and not to use or export it in or to any country or by any person subject to trade sanctions or an embargo. 12. GOVERNING LAW In short: British Columbia law applies, and the consumer protections where you live still apply too. These terms are governed by the laws of British Columbia and the applicable federal laws of Canada, and the courts of British Columbia have jurisdiction over any dispute. Nothing in these terms takes away any protection that the law where you live makes mandatory. 13. THE GALLERY In short: publishing to the Gallery is optional and has its own terms. The Software can publish images to the 360 Hextile Gallery. Doing so is entirely optional, and nothing you make reaches the Gallery unless you publish it. Gallery use is covered by the Gallery section of the Terms of Service at https://360hextile.com/legal/terms#gallery. Gallery access is a separate service and may be suspended or ended on its own — a Gallery ban never affects this licence or your ability to run the Software. 14.
